Simin Rahman, managing director of Transcom Beverages Limited, has been ordered to appear in court on November 16 in a case filed over alleged quality failures, excessive chemical use and violations of food packaging regulations involving the soft drink 7UP Natural Lemon Flavour Extra Fizz.
The case was recently filed by the health department of Dhaka South City Corporation (DSCC) at the Dhaka Pure Food Court. The court took cognisance of the case and ordered Rahman to appear in person on the scheduled date.
According to the case documents, three 200-millilitre bottles of 7UP Extra Fizz were collected as samples from Brothers Computers and Confectionery in Khilgaon on September 14 and sent to a laboratory for testing.
The complaint alleges that the beverage failed three of the six parameters specified under the Bangladesh Standards and Testing Institution’s standard BDS 1123:2022.
The case was filed by Md Kamrul Hasan, a DSCC safe food inspector and prosecuting officer. The complaint further alleges that the product was manufactured and marketed using artificial chemicals and chemical sweeteners in quantities exceeding the prescribed limits.
It also alleges that although the label states, “No sugar, but contains non-nutritive sweeteners,” the font used for the information is too small to be easily read. The complaint describes this as a violation of the Packaged Food Labelling Regulations, 2017, and the Product Packaging Rules, 2021.
According to the complaint, the laboratory report classified the beverage as not meeting the required quality standards and as unsafe. Citing potential public health risks, the plaintiff has asked the court to order the seizure and nationwide recall of the relevant batch, numbered 874, along with similar allegedly harmful beverages from shops and markets.
The case was filed under Section 58 of the Safe Food Act, 2013, citing alleged violations of Sections 26, 27, 32(a), 41 and 42.
The allegations have yet to be finally adjudicated by the court.
